Counting for life Online Terms and Conditions

These terms and conditions of use relate to the Counting for Life Online program (referred to as the program), the Counting for Life website and any other website owned and operated by Learning Links (referred to as website or websites). The terms and conditions of use relate to the automated functions of the program and website as well as the contents of the program and website.

Acknowledgment and Acceptance of terms of use

The Counting for Life Online program and website is operated by Learning Links, a not–for-profit organisation. Your participation in this program is governed by the following Terms and Conditions. You will be required to sign a statement acknowledging that you have read these terms and conditions and agree to them prior to receiving your username and password to participate in Counting for Life Online.  If you do not agree with these terms and conditions and sign a statement at the end of these terms and conditions agreeing that you will abide by them, you will not be able to participate in Counting for Life Online.  Breaching of any of these terms and conditions will mean that your username and password will be disabled immediately and you will not be able to continue with the existing program nor be eligible to complete a program at any time in the future.

Learning Links reserves the right to amend the Terms of Use at any time.

1. A username and password will be supplied to each individual ‘buddy’ and ‘child’.
2. It is the responsibility of each individual user to ensure his or her username and password remains secure and is not disclosed to anyone else.
3. Users must notify Learning Links if any unauthorised person becomes aware of their active username and password.  Notification can be by email or phone.
4. After completion of the program usernames and passwords will be disabled.  

Learning Links retains the right to monitor the point of origin for accessing Counting for Life Online by capturing an IP address for any session.

By participating in Counting for Life Online you are aware and agree to Learning Links taking a picture of you using your webcam, taking a video of you using your webcam or recording your voice at any time or for the entire session for any or all sessions. The pictures, video and recording will only ever occur when you are in direct contact with a child. Any pictures, recordings or video taken during any session will be kept for the period required by Australian law for keeping records for minors.

As a participant in the program you have consented to and provided a signed Working with Children Declaration prior to commencing the program. Usernames and passwords will not be issued if a signed Declaration has not been received.

As part of your participation in the program you agree not to divulge personal details such as your personal email address, mobile or home phone number and/or personal address to your buddy.  You agree not to arrange to communicate with your buddy through another internet medium such as a social networking site.  You also agree not to arrange to meet your buddy in person unless the opportunity for meeting your buddy has been approved by Learning Links and the parent or guardian of your buddy and that meeting is supervised at all times by the parent of guardian of your buddy or their designated authority.

Copyright of all information, material, text, graphics, audio/visual clips, games (collectively referred to as Contents) in the Counting for Life Online program and on the website is owned by Learning Links unless indicated otherwise.

You may use this material for your own personal reference only. Except for the temporary copy held in the computer's cache and a single permanent copy for your personal reference, the material may not otherwise be used, copied, reproduced, published, stored in a retrieval system, altered or transmitted in any form or by any means in whole or part (except where such use constitutes fair dealing under the Copyright Act) without the prior written approval of Learning Links.

Nothing displayed on Learning Links’ website or in the Counting for Life Online program should be construed as granting any licence or right of use of any logo or trademark displayed on a website, without written permission from Learning Links.

You may not use any part of the material on Counting for Life Onlineprogram to establish, maintain or provide, or assist in establishing, maintaining or providing your own publications, Internet site or other means of distribution.

The information contained on the website or in the program is provided by Learning Links in good faith. It is derived from sources believed to be accurate and current as at the date of publication. Your use of the Counting for Life Online program and the website is at your sole risk.

Learning Links does not warrant or make any representations regarding the use or the results of the use of the Contents on this site or in the program in terms of their correctness, accuracy, reliability, or otherwise. Your conduct

It is a condition of accessing the website and the program that you will be situated in a location that would not place a child at risk by ensuring all background stimulus is suitable for children’s viewing. Any pictures or video taken are likely to pick up background detail.

You agree not to use the Learning Links’ website or the program for 'spamming', junk mail, chain letters, contests, surveys, solicitations or any mass communications of any kind. You agree not to post or say any comments that contain any threatening, defamatory, harassing, stalking, racist, sexist, obscene, vulgar, pornographic, unlawful or profane information or material which violates or infringes upon the rights of any person. If you do, you agree to indemnify Learning Links for any losses, costs, expenses or damages that Learning Links may suffer as a result.

You must not transmit or attempt to transmit any material of any kind to this website or this program which contains a virus, malicious computer code or other harmful component or otherwise attempt to alter any of the content on this website or this program.
